Welcome to HipUp Fitness ("HipUp," "we," "us," or "our"). By creating an account or using our platform on this website, you agree to these Terms of Service. Please read them carefully.

1. Service Description

HipUp is an online fitness coaching platform with prerecorded workout videos for all age groups, including Kids (6-12), Teens (13-17), Adults (18-64), and Seniors (65+).

2. Account Terms

• You must be at least 13 years old to create an account. Users under 18 require parental or guardian consent.
• Each account is for a single individual unless a Family plan is offered. Family plan member count, household rules, and profile access will be defined in the final plan terms before paid launch.
• You are responsible for maintaining the security of your account and password.
• You must provide accurate and complete information when creating your account.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at HipUp support if you suspect unauthorized access to your account.

3. Subscription & Billing

• Free Accounts: Account creation may be available at no cost. Paid plan terms are shown before checkout.
• Paid Plans: Pro and Family options may be offered with plan details, included features, member limits, and renewal terms shown before checkout.
• Paid subscriptions are billed according to the plan terms shown at checkout.
• Payments are processed securely through Stripe. We will not store your full payment card details.
• Any future pricing changes will be communicated according to the final paid plan terms.

4. Refund Policy

Refund and cancellation terms are shown with active membership plans. For any billing or account question, contact us at HipUp support.

5. Content & Intellectual Property

• All workout videos, images, text, and other content on HipUp are owned by or licensed to HipUp Fitness and protected by copyright.
• Your account or subscription grants you a personal, non-exclusive, non-transferable license to stream available content for private, non-commercial use.
• You may not download, copy, redistribute, record, or publicly display any content from the platform.
• You may not use any automated tools to scrape, extract, or mirror our content.

6. Acceptable Use

You agree not to:

• Share your account credentials with anyone outside your subscription plan.
• Use automated bots, scrapers, or similar tools to access the platform.
• Attempt to bypass subscription restrictions or access controls.
• Use the platform for any unlawful purpose or in violation of any applicable law.
• Harass, threaten, or harm other users or HipUp staff.

7. Health & Fitness Disclaimer

HipUp provides fitness content for general wellness purposes. Our videos are not a substitute for professional medical advice, diagnosis, or treatment. Consult your doctor before starting any exercise program, especially if you have pre-existing health conditions. You exercise at your own risk, and HipUp is not liable for any injuries sustained during workouts.

8. Termination

• You may cancel your account at any time from your account settings or by contacting support.
• We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or abuse the platform.
• Upon termination, your right to access the platform and its content ceases immediately.

9. Limitation of Liability

To the maximum extent permitted by law, HipUp Fitness and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim related to the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Changes to These Terms

We may update these Terms of Service from time to time. When we make significant changes, we will notify you via email at the address associated with your account. Your continued use of the platform after changes take effect constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of HipUp shall be resolved in accordance with applicable law.
